Outstanding Finance Scams UK: How To Avoid Buying A Car That Is Not The Seller's

A car on finance belongs to the lender until the last payment. Here is how outstanding finance catches buyers out, the warning signs, and how to check before you pay.
Buying a car that still has finance on it is one of the most expensive mistakes a used car buyer can make. The seller may have every document and a friendly manner, and still not own the car.
This is general information, not legal advice. Finance agreements and lender rules vary.
Check this car free first: enter the registration at carverified.co.uk to confirm it matches the advert, then see what a full report adds on the pricing page.
How it works
Most cars bought on hire purchase (HP) or personal contract purchase (PCP) legally belong to the finance company until the final payment is made. The seller is only the registered keeper. Some sellers sell the car anyway, planning to keep the money and stop paying. The lender can later trace the car and try to recover it, which leaves you with a car you may lose and a seller who has gone.
There is a limited legal protection for some private buyers who buy in good faith, but it has exceptions and conditions, so do not rely on it.
Warning signs
•
The seller is vague about whether the car was bought outright.
•
The V5C shows the seller as keeper for a short time, or the car is a recent model that was probably bought on finance.
•
You are asked to pay cash or by transfer quickly.
•
The price is lower than similar cars, with a quick-sale story.
•
The seller says “the finance is nearly paid off” and asks you to pay the lender.

What to do
1.
Run a finance check on the registration before you travel.
2.
Ask the seller to confirm in writing that the car has no finance, and to get a settlement letter from the lender if there is some.
3.
Never pay the seller’s finance yourself on a promise they will transfer the car. Use a documented settlement that clears the agreement before you pay the balance.
4.
Check the V5C and the seller’s identity, and meet at the address shown on the V5C.
5.
Keep records of every message and payment.
If a car turns out to have finance
Contact the lender, and report the seller to Action Fraud, or Police Scotland on 101 if you are in Scotland. Citizens Advice can explain your position.
The finance check is the single check that stops this scam, and it is the reason finance is included from Silver Plus.
Which CarVerified report covers this?
Silver Plus is the tier that includes the outstanding finance check, which is the one that stops this scam. Gold includes it too, with the most complete report.
•
Free check: start with the free vehicle check to confirm the make, model, colour, year and MOT and tax status match the advert.
•
Silver: the core vehicle history check. Finance is not part of Silver, but it can be unlocked separately.
•
Silver Plus: adds the outstanding finance check.
•
Gold: the most complete report, adding ex-taxi, salvage and valuation checks.
See what each report includes on the pricing page or the sample report, and use the used car checklist when you view the car.

Is there finance on the car you're looking at?

If a used car still has outstanding finance, the lender can repossess it - even from you. You can't see it from the car or the V5C.
CarVerified Silver Plus (£5.99) includes the outstanding finance check, plus write-off and stolen checks.
Start with the free check - upgrade only if you want the full report.
